"Update on the Uniform Trust Code"
On July 17, 2016, New Jersey became the 32nd state to enact a “uniform” statute regulating trusts. This act, promulgated by the national Uniform Law Commission, has variations state by state and thus, each state law is different. Estate planners will need to review the 84 newly enacted statutes as they will have a tremendous impact on estate planning in the state of New Jersey. The New Jersey version is slightly different from the versions that some members may have considered such as the version enacted in Pennsylvania on November 6 2006 and in Florida on July 1, 2007.
