Session Description:

Many clients might consider establishing trusts in a jurisdiction other than their home state. Practitioners should be aware of the evolving trust laws in certain choice jurisdictions, including Delaware, South Dakota, Nevada, Tennessee, Alaska, and more. For those who do not practice in these jurisdictions, it can be overwhelming to compare and contrast these states’ trust laws; however, understanding the nuances and opportunities can help clients better plan and protect their assets in trust. In this session, Brittany Horn Cook, Wealth Planner and Fiduciary Council, of Tiedemann Trust Company, and Brian M. Balduzzi, Private Client Attorney, of Faegre Drinker Biddle & Reath LLP, debate Delaware and South Dakota trust laws, including asset protection, dynasty, decanting, trust administration, income tax planning and more. Come listen and participate to see which state comes out on top and which might be best for certain clients for trust planning.

Learning Objectives:
* Summarize the benefits of using South Dakota or Delaware for trust planning
* Differentiate between South Dakota and Delaware for income tax and business planning
* Discuss trust decanting and modifications, along with nonjudicial settlement agreements, in South Dakota and Delaware
* Debate first-mover and case law-forward Delaware and statute-ready and liberal-minded South Dakota
* Conclude with a discussion of the role of corporate trustees and advisors in South Dakota and Delaware
